A practical guide to HVNL obligations, fatigue rules, Chain of Responsibility and penalties for Australian transport operators
The Heavy Vehicle National Law (HVNL) is Australia's single set of rules for heavy vehicles over 4.5 tonnes gross vehicle mass (GVM). The National Heavy Vehicle Regulator (NHVR) administers it in every state and territory except Western Australia and the Northern Territory, which run their own heavy vehicle laws.
Six jurisdictions apply the HVNL as their own law: Queensland, New South Wales, Victoria, South Australia, Tasmania and the ACT. Each adopts it through its own act, which is why you'll sometimes see it referenced as the "Heavy Vehicle National Law (Queensland)" or the NSW equivalent, even though the underlying rules are the same. Western Australia and the Northern Territory sit outside this system and run their own heavy vehicle regulations, so an operator crossing into either state needs to check local requirements separately.
A vehicle counts as "heavy" once its GVM or aggregate trailer mass passes 4.5 tonnes, a threshold set by the NHVR. That covers everything from a small rigid delivery truck to a B-double. The National Transport Commission maintains the law itself, proposing amendments and reforms, while the NHVR handles day-to-day administration, compliance and enforcement.
What changed in the HVNL 2026 reform
The most recent update to the HVNL took effect on 1 August 2026, under the Heavy Vehicle National Law Amendment Act 2025. The NHVR has described it as the most significant overhaul of the law since it first commenced in 2012, shifting the system away from a purely compliance-driven approach and toward proactive, risk-based safety management. Changes include things like a new two-tier accreditation scheme and an expanded "unfit to drive" duty that gives drivers clearer legal footing to refuse unsafe work.
As a transport operator, your obligations under the HVNL fall into three practical buckets: what you load, what you drive, and who's behind the wheel.
Mass, dimension and loading limits. Loads have to sit within mass and dimension limits set for the vehicle type, and restraint has to hold the load securely for the whole trip, not just at departure. Following the 2026 update, general mass limits increased to align with the old concessional mass limits, and the general vehicle length limit grew from 19 to 20 metres, with no transitional grace period for these mass and dimension changes.
Vehicle condition. Brakes, steering, tyres and structural components need to meet the applicable vehicle standards, and defects have to be fixed before the vehicle goes back on the road. A standing vehicle inspection checklist and a vehicle maintenance log make this far easier to prove after the fact than a memory of "it looked fine."
Driver licensing and accreditation. Drivers need the correct heavy vehicle licence class for what they're driving, and operator accreditation is shifting from the old NHVAS scheme to a new General Safety Accreditation and Alternative Compliance Accreditation framework under the 2026 update covered above.
Fatigue rules set maximum work hours and minimum rest breaks for heavy vehicle drivers, with accreditation tiers that allow more flexible hours in exchange for stricter monitoring and record-keeping. Every driver working under standard hours has to keep a national driver work diary, a legal record of work and rest time that inspectors can check at any roadside stop. Since the 2026 update, work diary record-keeping has been simplified, and drivers now hold a new "unfit to drive" duty, meaning they have the legal right to refuse or stop driving if illness, injury, a health condition or alcohol or drugs make it unsafe to continue. Getting fatigue management right starts with realistic scheduling. A good fleet safety program builds rest breaks into the roster instead of treating them as something drivers have to fight for.
The Chain of Responsibility is the part of the HVNL that catches operators off guard, because it doesn't stop at the driver. Anyone who influences a transport task can carry legal liability if their decisions cause a breach:
Schedulers who set unrealistic delivery timeframes
Consignors and consignees who load or unload vehicles
Employers and prime contractors who direct drivers
Loading managers responsible for how freight is packed and secured
Every party in the chain has a primary duty to eliminate or minimise safety risks as far as reasonably practicable, and a due diligence duty to actively check the safety system is working, not just assume it is. This primary duty model replaced the old deemed liability approach in 2018, and the NHVR's guidance on the primary duty sets out exactly what it requires of each party.
The 2026 reform pushes this further, shifting the law's focus from pure compliance-checking toward proactive risk management shared across the whole chain, which raises the bar on what counts as adequate due diligence evidence. A scheduling manager who never sets foot in a truck can still be found in breach if their timeframes force a driver to speed or skip rest breaks.
The NHVR enforces the HVNL through roadside checks, audits and investigations, with breaches sorted into categories from minor infringements up to severe risk offences that carry court-imposed penalties. Penalty amounts and categories vary by breach type and are updated periodically, so check the current penalty schedule rather than relying on a fixed figure. Enforcement also differs slightly state by state, since each jurisdiction applies the HVNL through its own adopting legislation.
The HVNL is meant to be one national law, but crossing a state line still changes things in practice. A run from NSW into Queensland stays under the same underlying law, but with a different adopting act and minor local variations. A run that touches Western Australia or the Northern Territory is a different story: the HVNL simply doesn't apply there, so mass limits, licensing and fatigue rules default to each territory's own regulations. Operators running mixed interstate routes need to know exactly where that line sits before they plan a trip, not after a roadside check flags it.
In a CoR investigation, doing the right thing isn't enough on its own. You need to show you did it. That means dated inspection records, maintenance logs and evidence that due diligence checks actually happened, not just a policy that says they should. A heavy vehicle inspection template gives every depot the same standard to work from, which matters when you're trying to prove consistency across a fleet rather than one well-run truck.
The same problem shows up wherever fleets rely on paper. TaaSA, a fleet services company running 42 depots, had no real-time visibility into vehicle condition, and lost paperwork made it hard to prove anything after the fact — regardless of which country's regulator was asking. Moving inspections onto a digital system gave them 1,225 completed service inspections a month with searchable records instead of filing cabinets.
